Terms of Service

These Terms of Service govern your access to and use of FamSpendy, provided by Somi Technologies Ltd. By creating an account or otherwise using FamSpendy, you agree to be bound by these terms. If you do not agree, you may not use the service.

The service

FamSpendy is a personal finance application for sharing money with the people closest to you. It enables you to record expenses, scan receipts, set budgets, manage recurring bills, and interact with an in-app AI assistant called Somi in relation to your financial data. We may add, modify, or remove features from time to time at our discretion.

Your account

  • You must be at least 16 years old to use FamSpendy.
  • You are responsible for maintaining the confidentiality of your account credentials. Notify us at support@somitechnologies.com promptly if you suspect any unauthorised access.
  • You are responsible for the accuracy of the information you provide. The output of the service depends on the accuracy and completeness of the data you input.
  • Each user must maintain a single personal account. To share data with members of your circle, use the in-app invitation flow rather than sharing login credentials.

Subscriptions and billing

Access to FamSpendy requires a paid subscription. Pricing is displayed in the app prior to purchase. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.

  • Free trial: a 3-day free trial is offered. The trial converts to a paid subscription at the end of the trial period unless cancelled beforehand.
  • Payment: handled by Apple via the App Store or Google via the Play Store, depending on the platform on which you subscribed. We do not receive or store your payment card details.
  • Cancellation: you may cancel at any time through your App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period.
  • Refunds: refunds are handled by Apple or Google in accordance with their respective refund policies. We are unable to process refunds directly for in-app purchases.
  • Price changes: we will provide at least 30 days' notice by email and in-app before any change to subscription pricing. You may cancel before the change takes effect.

Acceptable use

You may use FamSpendy for personal and shared finance management with your circle. You may not:

  • Use the service for any unlawful purpose, including money laundering, tax evasion, or fraud.
  • Reverse-engineer, decompile, or otherwise attempt to derive the source code of the service.
  • Resell, sublicense, or use the service to provide a competing product or service.
  • Upload content to which you do not hold the necessary rights, or content that infringes the rights of third parties.
  • Use automated tools or scripts to send a high volume of requests, including to the AI assistant, in a manner that disrupts the service.
  • Attempt to access the data of another user.

The Somi AI assistant

FamSpendy includes an in-app AI assistant called Somi that uses third-party AI models to respond to questions about your financial data. Responses are generated by AI and may be inaccurate, incomplete, or out of date. Responses do not constitute financial, tax, or legal advice. You should treat the assistant's output as a starting point and independently verify any information that affects financial, tax, or legal decisions. We disclaim responsibility for decisions taken in reliance on the assistant's responses.

Your data and content

You retain ownership of your data, including expenses, categories, receipts, notes, and any other content you submit to FamSpendy. You grant us a non-exclusive licence to use that content solely to the extent necessary to operate the service for you. This includes storing it, displaying it, and transmitting the relevant portions to AI models when you make a request to the assistant. For further detail, see our Privacy Policy.

You may export your data and delete your account at any time from within the app under Settings → Account.

Intellectual property

We retain all right, title, and interest in FamSpendy, including the application, the FamSpendy brand, and all underlying code. These terms do not transfer any of our intellectual property rights to you. We grant you a limited, non-transferable, revocable licence to use FamSpendy in accordance with these terms.

Service availability

We aim to make the service available with high reliability but do not guarantee uninterrupted availability. From time to time we may need to take the service offline for maintenance or to resolve issues. Where reasonably possible, we will provide advance notice.

Termination

You may stop using FamSpendy and delete your account at any time. We may suspend or terminate your account if you breach these terms, if your payment fails and is not resolved, or if we reasonably believe your activity poses a risk to the service or other users. We will provide reasonable notice unless doing so would be inappropriate in the circumstances.

Limitation of liability

To the maximum extent permitted by applicable law, our total aggregate liability to you in respect of any claim arising out of or in connection with FamSpendy is limited to the greater of £100 or the subscription fees paid by you to us in the 12 months preceding the event giving rise to the claim.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under UK law.

Disclaimer

FamSpendy is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not authorised or regulated as a financial services provider; we do not provide financial advice, manage funds on your behalf, or execute payments between accounts.

Changes to these terms

We will notify you of any material changes by email and in-app at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms. If you do not accept the updated terms, you may cancel your subscription and delete your account.

Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these terms or the service will be subject to the exclusive jurisdiction of the courts of England and Wales, except where you have a non-waivable right as a consumer to bring proceedings elsewhere.
